THE EXPEDIENCY OF CHALLENGING THE ACTIONS OF AN INSOLVENCY PRACTITIONER IN THE CONTEXT OF BRINGING HIM TO CIVIL LIABILITY

In this work, the author examines the need for preliminary challenging of the actions or inactions of an insolvency practitioner before filing claims for bringing to civil liability. The issue has become relevant due to changes in law enforcement approaches reflected in judicial practice, which has allowed, at present, bypassing the procedure for appealing the action to immediately apply for recovery of damages. The study uses methods of analysis, synthesis, as well as a formal legal method.
