SPECIFICITY OF CRIMINAL LAW PROTECTION OF ITEMS OF SPECIAL VALUE FROM THEFT

The article examines the periods of formation of criminal law protection of cultural values in the domestic legislation. The article presents the features of the criminal law characteristics of some elements of the crime, providing for responsibility for the theft of cultural property. The main feature of the crime is the subject of the crime, their classification is proposed, the issues of competition of criminal law norms are considered, and attention is drawn to the need to consider other controversial circumstances of the commission of an unlawful act. Examples of investigative and judicial practice are given, and some problematic issues arising in the qualification of theft of items of special value are identified. Measures are proposed to improve the activities of the preliminary investigation bodies, as well as ways to improve legislation related to the protection of cultural property from unlawful encroachments.
