The article deals with one of the key aspects of administrative responsibility in the field of forest use - the problem of commensurability of administrative penalties and damages caused by offenders. Based on an analysis of current trends in law-making, the author concludes that the problem of illegal logging in Russia is systemic. The low efficiency of the legal framework the author relates to the fact that it is trying to regulate the legal relationship of forest use «Post factum». According to the author, the problem goes beyond the scientific and legal context and requires an examination on the conceptual political level. As a strategic policy of increasing the efficiency of the administrative and legal regulation of forest use in the Russian Federation the author suggests paying attention to the principle of preventive management.
