Regulation of active repentance in the criminal legislation of foreign countries

The article considers the specifics of regulating the active repentance of the guilty person in the criminal legislation of a number of foreign countries. The analysis is subjected to the legislation of the USA, Austria, Bulgaria, Holland, Spain, Latvia, Lithuania, Poland, Germany. On the basis of a comparative legal analysis, it is proposed to consider questions on the possibility of introducing new grounds for exemption from criminal responsibility and punishment in connection with active repentance, on granting exemption from criminal responsibility in connection with active repentance conditional, on postponing the serving of punishment in connection with active repentance and etc.
