Peculiarities of the UK case law on mediation

This article examines the peculiarities of the UK case law on mandatory mediation trials. On the basis of the presented decisions on the law enforcement practice of mediation various characteristic aspects of disputes, their essential interpretation are revealed, decisions are compared, as well as cases of their revision in the absence of attempts to settle the claims through ADR. The conclusion draws on the prospects of the successful implementation of mediation, as its application is gradually spreading.
