IMPACT OF THE WORLD CLIMATE AGENDA ON BUSINESS LAW INSTITUTIONS

Reikh Aleksandra Pavlovna  (student of the Faculty of Law of the Moscow State University. M.V. Lomonosov; Russia Moscow)

the article presents a study of the impact of the global climate agenda on the institutions of business law. The author focuses on the fact that in the world community today special attention is paid to the issue of reducing and neutralizing the carbon footprint. A number of business law institutions are undergoing changes due to global green trends both in Russia and abroad. Within the framework of this work, special attention is paid to the study of the impact of the climate agenda on such business law institutions as the securities market, namely the issuance of "green bonds", and carbon credits, as a type of economic tool used to reduce the negative impact on the environment. It is important to say about some changes that should be made to the list of principles of business law. The Russian legislator should provide a range of economic benefits and incentives for green sector issuers and investors to support their overall motivation to have a positive impact on the climate situation. Since the Bank of Russia is a body that regulates the securities market, certain benefits should be provided for precisely in the regulatory legal acts issued by it. These indulgences may relate to simplifying the admission of green issuers to the securities market, reducing the established reserve requirements for possible losses. According to the author, the impact of the global climate agenda on the institutions of business law is difficult to overestimate. Both at the international and national levels, states are modernizing certain legal institutions in order to have a positive effect on the environment and global climatic conditions. However, there are also legal gaps in the regulation of new, modernized institutions of business law. Also, for more effective use of new legal structures in the business area, it is necessary to consolidate a number of legal indulgences / benefits
