OPTION AGREEMENT TO CONCLUDE A TRANSFER CONTRACT AS A WAY TO ENSURE THE FULFILLMENT OF OBLIGATIONS: BY THE EXAMPLE OF FOOTBALL TRANSFERS

Under the article, it is proposed to consider the possibility of using an alternative way to enforce the debtor clubs obligations under transfer contracts, the terms of which provide for the possibility of making transfer payments for player transfer with deferred / installment payment. As such a enforcement mechanism, it is proposed to conclude an option agreement to conclude a transfer contract between the debtor club and the creditor club regarding sports rights to the same player whom the transfer contract is concluded with deferred / installment payment. The absence of scientific works and judicial practice on the stated topic indicates the novelty of this scientific work. According to research it is stated the fundamental admissibility of the use of the proposed enforcement mechanism under football players transfers. This conclusion is made on the basis of the author's comprehensive analysis of civil, labor and regulatory sports rules of law in the field of football.
