PSYCHOLOGICAL THEORY OF LAW AND ITS ROLE IN THE DOCTRINE OF NIHILISM

Sirin Sergey Anatolyevich  (Candidate of Philosophical Sciences, Associate Professor Irkutsk State Medical University of the Ministry of Health of Russia )

The author in the article considers the schools of natural law, the schools of positive law, as well as the psychological direction. The author notes that not only legal nihilism, but also other forms of nihilism that loudly declared themselves, weaving into the branch of law. It is concluded that nihilism is one of the signs of the evolutionary development of society, which is also confirmed by the philosophical concept of dialectical materialism, based on the three postulates of Hegel's dialectic. The author concludes that legal nihilism in its structural characteristics has only an object and a degree (depth). The attitude to nihilism as something negative, something that must be eradicated, destroyed and emasculated from legal reality, is fundamentally wrong, since this is an ordered type of thinking, logically connected and completely rational.

Keywords:nihilism, legal nihilism, theory of law, psychological theory, legal doctrine, psychology
