European Convention for the Protection of Human Rights and Fundamental Freedoms and Russian Legislation on Freedom of Expression: Some Problems of the Correlation

In the article features of a parity of the Russian legislation with norms of the European convention on protection of human rights and the basic freedom concerning maintenance of a freedom of speech are considered. The coincidence of the legal understanding regarding the impossibility of absolutizing freedom of speech was noted. As a result of the analysis, a negative trend was revealed in the form of a broad discretion of the national legislator and it was noted that there was an unresolved problem related to the competition of constitutional values. Suggestions have been made to improve norm-setting activities.
