The right to education as a fundamental constitutional human right in Germany

The right to education in Germany is proclaimed as a fundamental constitutional human right belonging to the second generation of rights. Conducting a comparative analysis of the basic law (Constitution) The authors came to the conclusion that the basic law of the Federal Republic of Germany declares only the principles of the realization of the right to education, namely the right to: education; freedom of teaching; the right to establish private schools; the right to choose an educational institution. During the study of individual norms of the Constitution of the lands, the authors noted that there is no single approach to the definition of the right to education in regional legislation, so they rightly conclude that for a single approach to understanding the principle under study, its introduction into the Basic Law of the Federal Republic of Germany is necessary.
