Actual problems of protection of property rights of subjects of civil legal relations

The article is devoted to the consideration and study of actual problems of protection of property rights of subjects of civil legal relations, which in modern times is an urgent topic for discussion in legal doctrine, since the importance of human rights and freedoms can hardly be overestimated. Within the framework of the study of this problem, the inconsistency of the theory of civil legislation, as well as gaps in the legal regulation of civil legal relations related to the protection of property rights, are revealed. Various definitions to the definition of the concept of "protection" of property rights are analyzed, it is proposed to improve legislation by amending the current Civil Code of the Russian Federation. In addition, the problem of the lack of legal consolidation of the category of "property rights" has been identified and an attempt has been made to fill the gap by introducing amendments to civil legislation. A debatable issue concerning the definition of the category of "civil liability" is also considered. The necessity of continuous improvement of the legislative regulation of the studied subject is established in order to establish equality of human and civil rights and freedoms.
