CATEGORY OF EVALUATION IN THE TEXTS OF COURT DECISIONS IN GERMANY AND RUSSIA (BASED ON GERMAN-LANGUAGE AND RUSSIAN-LANGUAGE TEXTS)

Borovkova Marina Vladimirovna  (Candidate of Philological Sciences (PhD in Philology), Associate Professor Ural State Law University named after V. F. Yakovlev )

The article presents a comparative analysis of the category of evaluation in the texts of court decisions in Germany and Russia. The enduring interest in this topic is primarily due to the fact that every individual and society as a whole constantly encounter the process and results of evaluation. The study of evaluation allows us to understand the mechanisms of thinking, identify its universal features, and the specificity of the evaluative worldview of different legal systems. It has been revealed that, despite common semantic parameters, Russian-language texts are characterized by explicitness, personalization, and a high frequency of ethical vocabulary (250 instances) and verbs of subjective attitude (330 instances). German-language texts, on the contrary, demonstrate implicitness, depersonalization, and a predominance of passive constructions. The differences are determined by national legal cultures and linguistic traditions. The research results can be used in legal linguistics, legal translation, and intercultural professional communication of lawyers.
