ORATORICAL TECHNIQUES IN COURT SPEECH IN A CIVIL CASE

The article discusses oratorical techniques used to convince the addressee in court speeches in civil cases. Based on the material of five successful speeches in the court debates of the modern Moscow lawyer M.M. Yarmush, the features of the construction are revealed and the logical and psychological-rhetorical methods of influence used by the speaker in speeches on various categories of civil cases are characterized. The author shows the conditionality of the choice of structural elements, logical argumentation and psychological and rhetorical methods of influencing a specific situation, the content of speech dictated by the circumstances of the case, as well as the professionalism and oratorical skills of the lawyer. The purpose of the article is to draw the attention of theorists and practitioners of judicial eloquence to the need to study court speeches in civil cases, to give practicing lawyers examples of the effective use of oratorical techniques in speeches in civil proceedings.
